Adjournment of Settlement Approval Hearing

SurfStitch Settlement Approval

On 9 August 2018 a Notice was sent to all eligible SurfStitch Class Action Group Members by the SurfStitch Administrators (also posted to this website) advising that the settlement proposal against the company would be heard by his Honour Justice Stevenson on 20 September 2018.

The litigation funders to the SurfStitch Class Actions (International Litigation Partners and Vannin Capital), now jointly cooperating, are now seeking leave to intervene in the settlement approval hearing to file evidence and make submissions regarding their interests in the settlement proposed against the company under the Ezibuy DoCA.  The litigation funders have engaged separate legal representation in this regard.

Given the funders’ need to prepare, the complexities of the matter, the number of parties involved and the availability of the Court, the settlement approval hearing of 20 September has been adjourned to Friday 28 September at which time a further hearing date or dates will be allocated.

We will continue to keep SurfStitch Class Action Group Members advised of further developments via our website, and encourage all members to review same for that purpose.
